Welcome to Green Bandit Gardening. By booking or using our gardening and maintenance services, you agree to the following Terms & Conditions.

 

1. Services Provided

We provide a range of gardening and maintenance services, including:

• Lawn mowing

• Edging

• Weeding

• Pruning

• Hedging

• Green waste removal

• General garden maintenance

Additional tasks may be offered if agreed upon.

 

2. Service Conditions

• If the property is significantly overgrown or has not been maintained, additional fees may apply.

• Work may be postponed if the lawn or soil is excessively wet or if weather conditions are unsafe (e.g., storms, extreme heat, high winds).

• Service pricing may be reviewed if the size or condition of the garden changes.

• A minimum service fee applies to all bookings unless otherwise agreed.

 

3. Client Responsibilities

• All hazards on the property must be disclosed (e.g., rocks, metal, irrigation components).

• We are not liable for damage to unmarked or hidden irrigation systems, cables, or underground services.

• Only areas clearly belonging to the Client will be maintained unless otherwise agreed.

• Safe and unobstructed access must be provided at the scheduled service time.

• Pets must be secured during service times.

• Before‑and‑after photos may be taken for documentation and quality control. Photos will not include identifiable people.

 

4. Payment Terms

• Invoices must be paid within 14 days.

• Late payments may incur interest of up to 25% per quarter, or the maximum allowed by law.

• Cancellations with less than 24 hours’ notice may incur a cancellation fee.

• If we attend the property and cannot gain access, a call‑out fee may apply.

 

5. Expenses

Any additional expenses required to complete the Services must be pre‑approved by the Client and will be reimbursed.

 

6. Termination

• Either party may terminate Services with 10 days’ written notice.

• Immediate termination may occur in the event of a material breach of these Terms.

• All outstanding invoices must be paid upon termination.

 

7. Quotes

• All quotes are based on the information available at the time of quoting and are valid for 7 days unless otherwise stated.

• Quotes are estimates only. Final pricing may vary depending on the actual condition, size, or accessibility of the property.

• If additional work is required that was not visible or disclosed at the time of quoting, an updated price will be provided before proceeding.

• Quotes may be provided via SMS, email, or messaging platforms. Acceptance of a quote — verbally or in writing — constitutes agreement to these Terms.

• For ongoing or recurring services, quoted prices may be reviewed if garden conditions change.

 

8. Confidentiality

Any personal or property‑related information provided by the Client is treated as confidential and will not be disclosed unless required by law.

 

9. Plant Health & No Guarantee of Survival

We do not guarantee the survival, performance, or future condition of any plants, lawns, or garden areas, as these depend on factors outside our control (including weather, soil conditions, pests, diseases, watering, and Client maintenance).

 

10. Chemical Use & Safety

If herbicides or other garden chemicals are used, they will be applied in accordance with product guidelines.
The Client is responsible for keeping pets and children away from treated areas until it is safe to return.

 

11. Green Waste Removal Limits

Green waste removal includes standard garden waste generated during the Service.
Excessive waste, such as large branches, storm debris, bulk pruning, or accumulated rubbish, may incur additional fees.

 

12. Access, Safety & Hazard Conditions

We may refuse, modify, or postpone work if:

• The area is unsafe,

• The terrain poses a risk to staff or equipment,

• excessive animal waste is present,

• Hazardous materials (e.g., syringes, sharp metal, glass) are found,

• or hazards were not disclosed by the Client.

We are not responsible for damage caused by objects hidden in long grass or garden beds.

 

13. Service Frequency Adjustments

If a scheduled service is skipped, delayed, or postponed at the Client’s request, resulting in increased growth or workload, the next service may be charged at an adjusted rate.

 

14. Intellectual Property

Any materials, designs, or content created by us during the provision of Services remain our property unless otherwise agreed.

 

15. Independent Contractor

We operate as an independent contractor. These Terms do not create an employment relationship, partnership, or joint venture.

 

16. Subcontracting

We may engage subcontractors at our discretion.

 

17. Equipment

We supply our own tools, machinery, and equipment unless otherwise agreed.

 

18. Indemnification

Each party agrees to indemnify the other for losses or damages arising from their own actions or omissions.

 

19. Notices

Formal notices must be provided in writing via email or the postal address supplied at the time of booking.

 

20. Governing Law

These Terms are governed by the laws of Victoria, Australia.

 

21. Amendments

Any changes to these Terms must be agreed to in writing.

 

22. Severability

If any part of these Terms is found invalid, the remaining sections remain enforceable.

 

23. Waiver

Failure to enforce any part of these Terms does not constitute a waiver of future enforcement.
