Terms and Conditions
Green Bandit Gardening
These Terms & Conditions (“Terms”) govern the provision of gardening and maintenance services (“Services”) by Green Bandit Gardening (“Service Provider”, “we”, “our”, “us”) to any customer (“Client”, “you”). By booking or using our Services, you agree to these Terms.
1. Services Provided
We offer the following Services:

Lawn mowing
-
Edging
-
Weeding
-
Pruning
-
Hedging
-
Green waste removal
-
General garden maintenance
Additional tasks may be provided if agreed upon.
2. Service Conditions

If the property is significantly overgrown or has not been maintained, additional fees may apply and will be quoted before work begins.

We may postpone mowing or other work if the lawn or soil is excessively wet to prevent damage.

Service pricing may be reviewed and adjusted if the condition or size of the garden changes over time.
3. Client Responsibilities

You must disclose any hazards on the property (e.g., rocks, metal, irrigation components).
(Derived from: “The Client is responsible for any damage caused to equipment due to undisclosed hazards.”) -
We are not liable for damage to unmarked or hidden irrigation systems, cables, or underground services.

We will maintain only the areas clearly belonging to the Client unless otherwise agreed.
4. Payment Terms

Invoices are issued and must be paid within 14 days.

Late payments may incur interest at up to 25% per quarter, or the maximum allowed by law.
5. Expenses
Any additional expenses required to complete the Services must be pre‑approved by the Client and will be reimbursed.
6. Termination

Either party may terminate Services with 10 days’ written notice.

Immediate termination may occur if a material breach of these Terms occurs.

Upon termination, all outstanding invoices must be paid.
7. Confidentiality
Any personal or property-related information provided by the Client is treated as confidential and will not be disclosed unless required by law.
8. Intellectual Property
Any materials, designs, or content created by us during the provision of Services remain the property of the Service Provider unless otherwise agreed.
9. Independent Contractor
We operate as an independent contractor. Nothing in these Terms creates an employment relationship, partnership, or joint venture.
10. Subcontracting
We may engage subcontractors at our discretion.
11. Equipment
We supply our own tools, machinery, and equipment unless otherwise agreed.
12. Indemnification
Each party agrees to indemnify the other for losses or damages arising from their own actions or omissions.
13. Notices
Any formal notices must be provided in writing via email or postal address supplied at the time of booking.
14. Governing Law
These Terms are governed by the laws of Victoria, Australia.
15. Amendments
Any changes to these Terms must be agreed to in writing.
16. Severability
If any part of these Terms is found invalid, the remaining sections remain enforceable.
17. Waiver
Failure to enforce any part of these Terms does not constitute a waiver of future enforcement.
